NBDA CONTINUES SUPPORT FOR QUICK-RELEASE FIGHT

More contributions by NBDA and BPSA in support of lobbying efforts to fight New Jersey QR ban bill.

The NBDA Board has again approved to commit even more funds to continue the fight against a bill proposed in New Jersey banning quick-release axles on all bicycles, adult as well as juvenile. While the law, if passed, would affect only New Jersey, it might set a national trend, making the fight a national issue.

The milestone achieved as of today through ongoing negotiations with the bill's author is an agreement to change the language in his bill to match that of the NJ Senate, which states that it would only ban QR wheels on children's bikes. With exception of some high-end BMX bikes, most kids bikes sold by independent dealers do not have quick-release axles anyway, so the amended bill would more reflect the current market and be more be focused toward this specific case. If that occurs, having a new law in place is considered the better option because without it, those in favor of the ban may continue to fight it indefinitely, incurring continuing cost for the bicycle industry. The proposed law was a response to injuries to children riding Wal-Mart bikes with quick-release wheels.

VICTORY IN NEW YORK STATE ON INTERNET SALES TAX!

Final Budget Includes Internet Sales Tax Provision

On Wednesday, April 9, booksellers and independent retailers in New York State received news that New York State's final budget includes a provision for Internet Sales Tax. With the budget passing the Legislature, it means that out-of-state online retailers now will be required to comply with New York State law and collect and remit sales tax on sales to state residents.

With the passage of the budget, New York State takes a significant step in establishing a level playing field for the state's retailers, a policy decision that is likely to be closely watched in other state capitols.

The victory is the culmination of months of intense lobbying by New York's independent booksellers and the American Booksellers Association, a campaign that included letters, e-mails, phone calls, and personal visits to legislators in Albany, the state capital. ABA's efforts included coordinating lobbying activities with other associations representing independent retailers in New York and working closely with the New Atlantic Independent Booksellers Association (NAIBA) and the Retail Council of New York State, which played a crucial role in face-to-face discussions with key elected officials in Albany.

"Independent booksellers -- indeed all independent retailers -- in New York are elated to hear that the new budget makes clear that equity and fairness are the guiding principles for the state," said Oren Teicher, ABA COO. "From the beginning, all we have asked for is an even playing field so that all retailers get the same treatment from New York. This has never been a case of enacting a new tax; rather, we have simply called for the equitable enforcement of existing tax law."

How does this affect the Bicycle Industry?
Comprised of approximately 4500 brick-and-mortar stores, bicycle industry sales have a major and direct impact on local, state, and federal taxes. Portions of these taxes are applied towards advocacy programs supporting increased bicycle access ways and safer routes to school across the United States. Communities with increased bicycle access and safer routes foster larger cycling populations, healthier communities, and ultimately a larger base for cycling sales. Non-collected sales taxes resulting from internet-based sales extend into the billions, negatively affecting many of these programs. Retailers avoiding this tax in many ways are non-contributors to such programs.

The NBDA's mission is to Lead Bicycle Retail to Excellence. We endorse this effort and are a supporting member of the e-Fairness Coalition in Washington, D.C., a national organization advocating for fair retail practices, because we believe that all bicycle retail should contribute and participate in this economy fairly and on a level-playing field.
